We know Terms & Conditions aren't the most exciting part of launching a business.
But they're here to make sure both sides know what's expected, what's included and how we'll work together.
We want Lumen Launch to feel collaborative, supportive and straightforward from the first conversation to launch day.

Welcome to Lumen Launch.
These Terms of Service set out the terms on which Lumen Launch (“Lumen Launch”, “we”, “us” or “our”) provides website design, branding, digital marketing, social media, content, event planning and related creative services to clients (“you” or “the Client”).
By accepting a proposal, quotation, booking or invoice from Lumen Launch, you agree to these Terms of Service.
We want working with Lumen Launch to feel straightforward, collaborative and enjoyable, so we've kept these terms as clear as possible.

Lumen Launch provides creative and business support services which may include:
Website design and development
Website copywriting and content
Branding and brand strategy
Logo and visual identity design
Social media strategy and management
Social media content creation
Photography and videography
Content and media packages
Website management
SEO and digital optimisation
Business launch support
Launch strategy and campaigns
Event planning and management
Wedding planning and coordination
Corporate and private event planning
Other creative or consultancy services agreed between us
The exact services included in your project will be set out in your proposal, quotation, package description or other written agreement.
If something isn't specifically included in your agreed scope, it isn't automatically included in the project.

A project is considered booked once:
You have accepted the proposal or quotation;
You have paid the required deposit; and
We have confirmed your booking in writing.
Payment of the deposit confirms that you have read and accepted these Terms of Service.
We may decline a project where we do not believe our services are suitable for your requirements, availability or budget.

Unless otherwise agreed in writing, a non-refundable deposit is required to secure your project date.
The remaining balance will be payable according to the payment schedule stated in your proposal or invoice.
For smaller projects, we may require full payment before work begins.
For larger projects, we may agree a payment plan.
Work may be paused if an invoice becomes overdue.
We reserve the right to withhold delivery of final files, website launch or other completed work until all outstanding invoices have been paid.

Quotes are based on the requirements discussed with you at the time of booking.
If your requirements change during the project, additional work may be charged separately.
This may include:
Additional website pages
Additional design concepts
Additional rounds of revisions
Additional copywriting
Additional meetings
Additional content
Additional functionality
Additional event planning
Additional suppliers or services
Significant changes to the original brief
Where possible, we will discuss any additional costs with you before carrying out the additional work.

We work collaboratively with our clients, and your input is an important part of the process.
You agree to provide us with the information, content, images, logins, approvals and feedback reasonably required to complete your project.
This may include:
Brand information
Business details
Images and photography
Text and copy
Product or service information
Testimonials
Pricing
Contact information
Social media access
Domain or website access
Other relevant materials
You are responsible for ensuring that information you provide to us is accurate and that you have permission to use any materials supplied.
Delays in providing information or approving work may affect the project timeline.

Your project will include the number of design concepts and revision rounds specified in your proposal.
We encourage clients to provide consolidated feedback wherever possible.
Requests for significant changes after approval, or revisions outside the agreed scope, may incur additional charges.
Once a design, website page, brand element or other deliverable has been approved, further substantial changes may be treated as additional work.

For website projects, we will agree the platform, functionality and number of pages as part of your proposal.
Unless specifically agreed otherwise, Lumen Launch does not guarantee:
A specific position in Google search results
A specific number of website visitors
A specific number of enquiries or sales
Specific business growth or financial results
Website hosting, domain registration, email services, premium plugins, subscriptions, stock imagery and other third-party services may be charged separately.
Where a third-party platform such as Squarespace is used, you are responsible for maintaining any ongoing subscription or hosting fees once the project is complete, unless otherwise agreed.

You are responsible for checking and approving the final website content before launch.
You are responsible for ensuring that information such as:
Prices
Contact details
Business information
Terms and conditions
Policies
Opening hours
Product/service descriptions
is accurate.
Lumen Launch is not responsible for errors that have been approved by you.
Where we provide copywriting, we will create content based on the information and direction you provide. You remain responsible for approving the final wording.

Where SEO is included within your package, we may provide basic on-page optimisation such as page titles, meta descriptions, headings, keywords and website structure.
SEO results cannot be guaranteed.
Search engine algorithms and ranking factors are outside our control.

Once all invoices relating to a project have been paid in full, you will receive the agreed final brand assets and deliverables.
Unless otherwise agreed, the final approved logo, brand identity and other bespoke creative assets created specifically for you may be used by you for your business.
Lumen Launch retains ownership of:
Working files
Unused concepts
Internal templates
Processes
Systems
General design methods
Pre-existing Lumen Launch materials
Unless specifically agreed, editable source files are not automatically included.

Some projects may use third-party services, suppliers, software, fonts, photography, stock imagery, plugins, hosting providers or other external services.
Where applicable, these may be subject to the third party's own terms and licensing restrictions.
You are responsible for ongoing third-party subscription costs unless we have specifically agreed otherwise.

Where photography or videography is included, the scope, location, duration and deliverables will be agreed in advance.
Third-party photographers, videographers or content creators may be used where appropriate.
Unless specifically agreed, raw or unedited files are not included.
You are responsible for ensuring that any people appearing in content have provided any necessary permissions.

For event planning and management services, the exact scope will be agreed in your proposal.
Lumen Launch may coordinate third-party suppliers including venues, caterers, photographers, entertainment providers, florists, stylists, AV suppliers and other event professionals.
Unless explicitly stated otherwise, Lumen Launch acts as a planner/coordinator and does not directly provide these third-party services.
Third-party supplier costs may be payable separately and may be subject to the supplier's own cancellation and booking terms.
We will take reasonable care when recommending or coordinating suppliers but cannot guarantee the performance, availability or conduct of an independent third-party supplier.

Events can involve significant advance commitments and supplier costs.
If you cancel or significantly change an event, you may remain responsible for costs already incurred or committed on your behalf.
Any cancellation terms specific to your event will be set out in your proposal or event agreement.
Where third-party suppliers have their own cancellation policies, those policies may also apply.
We recommend that clients consider appropriate event insurance where relevant.

We understand that life and business can get busy.
However, if a project is delayed because required information, content, approvals or feedback are not provided within a reasonable timeframe, the original delivery date may need to move.
If a project is paused for an extended period, we may need to reschedule the work based on our availability.
Additional work caused by significant delays or changes may be chargeable.

If you decide to cancel a project after booking, your deposit will normally remain non-refundable because it secures your project time and covers work undertaken in preparation.
If work has already commenced, you may also be responsible for payment for work completed up to the cancellation date and any non-refundable third-party costs already incurred.
Any specific cancellation rights applying to your booking will be set out in your proposal or contract.

We reserve the right to cancel or refuse to continue a project where:
Invoices remain unpaid;
The client repeatedly fails to provide required information;
The project scope has materially changed;
There is abusive, threatening or inappropriate behaviour;
Continuing the project would create a conflict of interest; or
We are unable to reasonably deliver the agreed services.
Where we cancel a project for reasons within our control, we will discuss the appropriate next steps with you and, where appropriate, refund payments relating to work that has not been carried out.

You confirm that any text, photographs, logos, videos, graphics, documents or other materials you provide to Lumen Launch are either owned by you or that you have permission to use them.
You agree to indemnify Lumen Launch against claims arising from your unauthorised use of third-party materials.
We may request evidence of licensing or permission where appropriate.

We love celebrating the work we create.
Unless you specifically ask us not to, Lumen Launch may display completed work in our portfolio, website, social media, marketing materials and case studies.
This may include screenshots of websites, branding, photography or other project outputs.
If you require confidentiality or do not want your project shared publicly, please let us know before the project begins.

We will treat confidential business information shared with us during your project with reasonable care and will not knowingly disclose it to third parties except where necessary to provide the agreed services or where required by law.
You agree to do the same in relation to confidential information belonging to Lumen Launch.

We will process personal information in accordance with applicable UK data protection legislation and our Privacy Policy.
Where we require access to your customer or business data to provide services, you remain responsible for ensuring that you have the appropriate permissions and legal basis to provide that information.

We will provide our services with reasonable care and skill.
However, Lumen Launch is not responsible for indirect or consequential losses, loss of profits, loss of business, loss of opportunity or loss of data arising from the use of our services, except where such liability cannot legally be excluded.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be limited or excluded.
Where services rely on third-party platforms, suppliers or software, we cannot guarantee their continued availability or performance.

We will not be liable for delays or failure to perform our obligations where this is caused by circumstances outside our reasonable control.
This may include serious illness, technical failures, natural disasters, extreme weather, strikes, government restrictions, supplier failure or other unforeseen circumstances.
We will make reasonable efforts to communicate with you and find an alternative solution where possible.

Our normal communication will take place by email and/or agreed project management channels.
We aim to respond to client communications within a reasonable timeframe, normally within 2–3 working days.
We don't expect clients to be available 24/7, and we ask for the same consideration in return.

Lumen Launch is a collaborative service.
We will give professional recommendations based on our experience, but the final decisions about your business, brand, website, marketing and event remain yours.
We want you to leave a project feeling confident about what you've built, rather than dependent on us forever.

These Terms of Service are governed by the laws of England and Wales.
Any disputes arising in connection with these Terms will be subject to the jurisdiction of the courts of England and Wales, unless applicable law requires otherwise.
